歡迎瀏覽 赤道光園（下稱「本平台」或「我們」）。本條款及細則（「本條款」）規範閣下進入及使用本網站、流動應用程式及相關服務。
閣下使用本平台（包括註冊帳戶、購買商品或門票、申請會籍），即表示閣下已閱讀、理解並同意受本條款及我們的私隱政策聲明所約束。如閣下不同意本條款的任何部分，請立即停止使用本平台。
Welcome to Alialand (hereinafter referred to as "the Platform", "we", or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, mobile application, and related services.
By using the Platform (including registering an account, purchasing items or tickets, or applying for membership), you signify that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy Statement. If you do not agree to any part of these Terms, please discontinue using the Platform immediately.
知識產權 Intellectual Property
本平台所載的所有內容（包括但不限於文字、圖像、標誌、音頻、視頻、軟件代碼及介面設計）均屬我們或其授權人所有，並受版權、商標及其他知識產權法律保護。

許可使用： 閣下僅獲授權將本平台內容用於個人及非商業用途。

禁止行為： 未經我們事先書面同意，閣下不得複製、轉載、修改、分發、展示、表演或將本平台內容用於任何商業目的。
All content contained on the Platform (including but not limited to text, images, logos, audio, video, software code, and interface design) is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Permitted Use: You are granted a limited license to use the content of the Platform for personal and non-commercial purposes only.

Prohibited Acts: Without our prior written consent, you may not copy, reproduce, modify, distribute, display, perform, or use the content of the Platform for any commercial purpose.
帳戶註冊與安全 Account Registration and Security
為了使用特定功能（如購物、會員服務），閣下可能需要註冊帳戶。

資料準確性： 閣下承諾提供真實、準確、最新及完整的個人資料。

帳戶安全： 閣下有責任妥善保管帳戶名稱及密碼。閣下同意對其帳戶下發生的所有活動承擔全部責任。

終止權利： 如我們合理懷疑閣下違反本條款，我們保留隨時暫停或終止閣下帳戶的權利，而無須事先通知。
To access certain features (such as shopping or membership services), you may be required to register an account.

Accuracy of Information: You undertake to provide true, accurate, current, and complete personal information.

Account Security: You are responsible for maintaining the confidentiality of your account username and password. You agree to accept full responsibility for all activities that occur under your account.

Right to Terminate: If we reasonably suspect that you have violated these Terms, we reserve the right to suspend or terminate your account at any time without prior notice.
銷售與交易 Sales and Transactions
本條款適用於透過本平台進行的所有購買行為（包括藝術品、商品、活動門票）：

價格與付款： 所有價格以港幣（HKD）標示基準，實質價格有機會因應不同地區匯率有所不同。閣下須在交易時支付全額款項。我們使用第三方支付網關處理付款，並不儲存閣下的完整信用卡資料。

訂單確認： 只有當我們向閣下發出確認電郵後，交易方視為完成。

退款政策：

商品： 除商品有損壞或與描述不符外，售出貨品概不退換。

門票： 除非活動取消或改期，否則所有門票一經售出，概不退換或退款。

活動取消： 如活動因惡劣天氣或不可抗力因素取消，我們將根據主辦方的政策安排退款或改期，但不承擔閣下因此產生的額外費用（如交通費）。
These terms apply to all purchases made through the Platform (including artworks, merchandise, and event tickets):

Price and Payment: All prices are denominated in Hong Kong Dollars (HKD). Actual prices may vary depending on exchange rates in different regions. You must pay the full amount at the time of the transaction. We use third-party payment gateways to process payments and do not store your full credit card information.

Order Confirmation: A transaction is considered complete only after we have sent you a confirmation email.

Refund Policy:

Merchandise: All sales are final, except for items that are damaged or not as described.

Tickets: Unless an event is cancelled or rescheduled, all tickets sold are non-refundable and non-exchangeable.

Event Cancellation: If an event is cancelled due to bad weather or force majeure, we will arrange for refunds or rescheduling in accordance with the organizer's policy, but we will not be liable for any additional costs incurred by you (such as transportation).

Accuracy of Information: While we strive to ensure accuracy, we make no representations or warranties, express or implied, regarding the accuracy, completeness, or timeliness of the content on the Platform.
責任限制 Limitation of Liability
在適用法律允許的最大範圍內，赤道光園 及其關聯公司、董事、員工或代理人，無須對因使用或無法使用本平台而引致的任何直接、間接、附帶、特殊或相應而生的損害（包括利潤損失、數據丟失）負責。
若我們被判定須負上責任，我們的總賠償責任上限不應超過閣下在引發索賠的交易中向我們支付的金額。
To the fullest extent permitted by applicable law, Alialand and its affiliates, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, or consequential damages (including loss of profits, loss of data) arising out of the use of or inability to use the Platform.
If we are found to be liable, our total aggregate liability shall not exceed the amount paid by you to us in the transaction giving rise to the claim.
權利保障及法律追究 Protection of Interests and Legal Recourse
秉承共贏的原則下，閣下承諾在使用本平台時，不得從事任何損害赤道光園、其關聯公司或本平台合作藝術家之合法權益（包括但不限於知識產權、商譽及經濟利益）的行為。如閣下違反本條款或因其行為導致上述主體遭受損失，我們保留採取一切法律行動的權利，包括但不限於向法院提起訴訟、申請禁制令，並要求閣下賠償所有相關損失（包括但不限於律師費、調查費及商譽損失賠償）。
Adhering to the principle of win-win cooperation, you undertake not to engage in any act that may damage the legitimate rights and interests (including but not limited to intellectual property, reputation, and financial interests) of Alialand, its affiliates, or the artists collaborating with the Platform. In the event of your breach of these Terms or if your actions cause any loss or damage to the aforementioned parties, we reserve all rights to take any and all legal actions, including but not limited to initiating legal proceedings, seeking injunctive relief, and claiming for all related damages (including but not limited to legal fees, investigation costs, and damages for loss of reputation).
第三者權利 Third Party Rights
根據《合約（第三者權利）條例》（香港法例第 623 章），非本條款協議一方的人士無權強制執行本條款的任何內容。
Under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong), a person who is not a party to these Terms has no right to enforce any provision of these Terms.
適用法律及管轄權 Governing Law and Jurisdiction
本條款受香港特別行政區法律管轄，並按其解釋。閣下同意接受香港法院的專屬司法管轄權管轄。
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong.
語言 Language
本條款及細則的中英文版本如有歧異，概以英文版本為準。
In the event of any discrepancy between the English and Chinese versions of these Terms and Conditions, the English version shall prevail.
